As many of you know, the PCCC has been strongly pushing back on the so-called “Good Cause” eviction bill. It has been our position that this legislation was not intended to include Co-ops. The bill in its’ current form does not explicitly state that Co-ops are excluded and we are fighting hard to have this corrected. Please note that tomorrow the New York State Senate Judiciary Committee and Housing Committee will be holding a joint hearing on this bill.
The PCCC has already submitted written testimony requesting the technical correction to exclude Co-ops. In addition, PCCC co-President’s Bob Friedrich and Warren Schreiber and Legal Advisor Geoffrey Mazel, Esq., have been invited to testify orally on behalf of the Co-op community. (TESTIMONY CLICK HERE). In addition, we received testimony from the Co-op Board President’s representing over 12,000 units of housing and submitted it to the Joint Committee. We feel this strong showing will bode well for our position.
As we have stated on many occasions, this bill would be disastrous for Co-ops if passed in its’ current version. It would make collecting arrears much more expensive and problematic. In addition, it would limit a Co-op’s ability to raise maintenance by more than 3%, no matter what the economics would dictate.
We are hopeful our efforts will be productive and result in the requested Co-op exclusion. More to follow as the situation develops.
